MyMoments

These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you (the “User”) and TheDev050 (the “Developer”) governing your access to and use of the MyMoments application (the “Application”). By downloading, installing, or otherwise using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Application.
1. The Application
The Application is an on-device keeper of the dates that matter in your life. It lets you save moments — milestones, love, family, travel, career, firsts and remembrances — each with a date, the people who were there, and a note in your own words, and shows them together on a vertical timeline. It can also replay your moments as a full-screen reel: with your permission, the Application reads the photos and videos already stored on your device and selects those taken around the same day of the year as a saved moment, presenting them as a short slideshow. You choose, for each moment individually, whether it is linked to your gallery at all, and you control how wide the matching window is. Photos and videos are read from your device solely to display them to you inside the Application; they are never copied to the Developer, uploaded, transmitted, or shared with any third party, and the Application does not modify or delete them. The Application can optionally remind you when a saved date comes back around. All moments, notes and settings are stored locally on your device. The Application functions without any network connection and does not synchronise your data to any external service.
2. Data and Privacy
The Application operates entirely on your device. The Developer does not collect, store, transmit, sell, or otherwise process any personal data or user content on any server, cloud service, or other remote infrastructure. The Application does not require an account, registration, or login. Any data you create within the Application remains solely on your device and under your control, and the Developer has no access to it. You are solely responsible for retaining backups of such data.
3. Licence
Subject to your compliance with these Terms, the Developer grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Application on devices that you own or control, solely for your own lawful purposes. All rights not expressly granted are reserved by the Developer.
4. Acceptable Use
You agree not to copy, modify, reverse engineer, decompile, disassemble, distribute, sublicense, or create derivative works of the Application except to the extent such restriction is prohibited by applicable law. You agree to use the Application only for lawful purposes and in compliance with all applicable laws and regulations.
5. Intellectual Property
The Application, including its software, design, and all associated intellectual property, is and shall remain the exclusive property of the Developer. These Terms do not transfer to you any ownership interest in the Application.
6. Disclaimer of Warranties
The Application is provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer does not warrant that the Application will be uninterrupted, error-free, or free of harmful components. You use the Application at your own risk and discretion.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of, or inability to use, the Application.
8. Changes to These Terms
The Developer may revise these Terms from time to time. Continued use of the Application following any such revision constitutes your acceptance of the revised Terms.
